Movnorth.com is intended only to serve as a preliminary medium of contact and exchange of information for its users / members / visitors who have a bona fide intention to contact and/or be contacted for the purposes related to genuine existing job vacancies in Canada and for other career enhancement services.

By accessing the website Movnorth.com as a Visitor and/or by clicking on “Join Us” as a registered user and/or subscribing to our services you agree to our "Terms of Use". These terms of Use create a legally binding contract (the “Agreement”) between you (“User/You”) and Culture Capital Corp. (“Movnorth/Company”) for use of this website and our services. By accessing Movnorth or completing the “Join Us” formalities or subscribing to our services you will be deemed to have confirmed your understanding and acceptance of the Agreement. Users are eligible to enter into this Agreement if you are 18 years and above and capable of entering into a Contract.

Your use of our Services is also subject to our Privacy Policy which covers how we collect, use, share, and store your personal information and which shall be deemed to be a part of this Agreement.

MovNorth or related services or product that is subscribed to or used (whether the same is paid for by you or not) is meant for the Purpose aforementioned and only for the exclusive use of the subscriber/registered user. Copying or downloading or recreating or sharing passwords or sublicensing or sharing in any manner which is not in accordance with these terms, is a misuse of the Platform and/or service and Movnorth reserves its rights to act in such manner as to protect its loss of revenue or reputation or claim damages including stopping your service or access and reporting to relevant authorities. In the event you are found to be copying or misusing or transmitting or crawling any data or photographs or graphics or any information available on Movnorth for any purpose other than that being a bonafide Purpose, we reserve the right to take such action that we deem fit including stopping access and claiming damages.

The site is a public site with free access and Movnorth assumes no liability for the quality and genuineness of responses. Movnorth cannot monitor the responses that a person may receive in response to information he/she has displayed on the site. The individual/company would have to conduct its own background checks on the bonafide nature of all response(s).

Movnorth will not be liable on account of any inaccuracy of information on this web site. It is the responsibility of the User to further research the information on the site. Using content from Movnorth.com for derivative works with a commercial motive without prior written consent is strictly prohibited. The user shall not upload, post, transmit, publish, or distribute any material or information that is unlawful, or which may potentially be perceived as being harmful, threatening, abusive, harassing, defamatory, libelous, vulgar, obscene, or racially, ethnically, or otherwise objectionable.

The user expressly states that the resume/insertion or information/ data being fed into the network of Movnorth by the user is correct and complete in all respects and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. Movnorth expressly disclaims any liability arising out of the said resume insertion/information/ data so fed into the network by the user. Further, the user agrees to indemnify Movnorth for all losses incurred by us due to any false, distorted, manipulated, defamatory, libelous, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable averments made by the user on the network.

The User is solely responsible for maintaining confidentiality of the User password and user identification and all activities and transmission performed by the User through his user identification and shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions and Movnorth assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the subscriber online / off-line. If an organization/Company is a Subscription User, you have the right to authorize/ nominate users to manage and operate the account on behalf of the organization/Company and to control access to and get reports on use of such paid Service.

The User/Subscriber/Visitor to Movnorth does hereby specifically agree that he/she shall, at all times, comply with any applicable laws while assessing or feeding any resume/ insertion or information/data on Movnorth.

The following actions will inter alia constitute a misuse of the services offered by Movnorth are strictly prohibited:

Copying, extracting, downloading, sharing, modifying, selling, storing, distributing, making derivate works from or otherwise exploiting any content, data, information, including profiles, curriculum vitae, photographs and/or graphics, available on Movnorth, in any manner or for any purpose which is not, consistent with the Purpose and/or in accordance with the Terms of Use.

Users are expressly prohibited from using or exploiting Movnorth and/or any content or data provided therein for: any commercial purposes such as creating alternate databases, extending access to Movnorth to third parties without prior written consent; and/or for seeking fees in the name of Movnorth; and/or approaching candidates/jobseekers for any purposes other than for specific existing vacancies; and/or Sharing access with persons who are not contracted with Movnorth.

Reselling the products/services offered by Movnorth

Gaining or attempting to gain unauthorized access (inter alia by hacking, password “mining” or any other means) to: (a) any portion or feature of Movnorth or any of the services or products offered on or through Movnorth which are not intended for you; (b) any server, website, program or computer systems of the Company or any other third parties and/or Users; Modifying the services provided through Movnorth or their appearance using any technology or overlay any additional offering on top of such services or simulate Movnorth services or its functions in any manner whatsoever without our explicit consent obtained in writing.

  • Accessing Movnorth through interfaces other than those expressly provided by Company; Attempting to breach or breaching any security or authentication measures set up by the Company in relation to Movnorth and/or attempting to probe, scan or test the vulnerability of the Company’s system or network;

  • Scraping, bulk-downloading, replicating or otherwise extracting any information or data from Movnorth (by any process, whether automatic or manual) to offer any products or services which are similar to or may in any manner compete with the products or services of the Company;

  • Reverse engineering, decompiling, disassembling, deciphering or otherwise attempting to do any of the aforesaid or deriving the source code for the Site or Application or any related technology or any part thereof;

  • Circumventing or attempting to circumvent any technological protections used or employed by the Company or by any third party in order to protect the content on Movnorth and/or to exclude robots, spiders etc. from crawling and /or scraping content from Movnorth. Interfering with or disrupting or attempting to interfere with or disrupt (including by using any device, software or routine), the use of Movnorth or any computer networks connected to Movnorth, by any other User;

  • Developing, using or attempting to use any automated program, scripts, robots, third party software or system or any similar or equivalent process (including spiders, robots, crawlers, browser plug-ins/extensions/add-ons, iframes on third party sites, mirroring, HTML parsers etc.) to access, navigate, search, copy, monitor, download, scrape, crawl or otherwise extract or modify in any manner, any data or content from Movnorth without our explicit consent obtained in writing;

  • Impersonating any other person or entity, or making any misrepresentation as to your employment by or affiliation with any person or entity; Forging headers or in any manner manipulating identifiers in order to disguise the origin of any user information; Stalking, threatening, or in any manner harassing any other User; Imposing an unreasonable or disproportionately large load on MovNorth.com infrastructure; Engaging in “framing,” “mirroring,” or otherwise simulating the appearance or function of MovNorth.com (or any part thereof) and providing deeplinks into Movnorth (or any part thereof) without prior permission of Company.

  • Spamming Movnorth or any other Users including by uploading, posting, emailing, SMS, transmitting or otherwise making available either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail.

  • Using Movnorth or the contact details of Users for transmitting marketing and promotional mailers/ Offensive messages/ messages or communications using any media that are unrelated to recruitment or sending unsolicited commercial communications with misleading subject lines in order to intentionally obfuscate the original message.

In case of any misuse of the services offered by Movnorth, we reserve our rights to take any actions as it may deem fit, including (i) suspending or terminating your access to MovNorth.com forthwith and without any notice; (ii) removing or disabling any content which is non-compliant with the Terms and Conditions; and/or (iii) reporting the incident/ misuse to relevant authorities and/or initiating any legal proceedings. In case your misuse of Movnorth results in or is likely to result in any loss or depletion of revenue, reputation or customer base. Movnorth additionally reserves its right to seek adequate relief against the said misuse, including relief by way of damages, injunction, etc.

The user shall not infringe on any intellectual property rights of any person / entity or retain information / download any information from any computer system or otherwise with an intention to do so.

If you buy any of our paid Subscription Services, you agree to pay us the applicable fees and taxes for the paid Services. Failure to pay these fees will result in the termination of your Subscription.

Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates). All payment information is stored by our Payment Processor Stripe and not by us. We do not process, hold, or store any User credit card or payment information. If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future any charges, you should cancel before the renewal date. Refunds may be processed upon application and cause only at our sole discretion. For cancelling your subscription, applying for a refund or requesting an invoice you may write to us at vikram@movnorth.com.

Unless otherwise specified and notwithstanding anything contained in any other agreement or arrangement, by whatever name called, the performance obligation of Movnorth is to provide access of its on-line portal to the User for the duration of the subscription period. Any agreement for a subscription / usage entered into by MovNorth.com does not confer exclusivity of service on any subscriber / user. The services provided by MovNorth do not extend to acting as an agent (express or implied) on behalf of any subscriber or user.

Movnorth will not be party to any legal proceedings between a user (e.g. a subscriber) and a party contracted through the site. In case Movnorth is implicated in any legal proceedings, costs will be recovered from the party that names Movnorth. Movnorth however will abide with any court order served on it through due process.

The Terms and conditions mentioned above regulate the usage of Movnorth. Any person using Movnorth in violation of the stipulations contained in the Terms and Conditions of Movnorth shall render himself/herself liable to appropriate action in a court of law.

We may occasionally update/modify this Agreement. We encourage you to periodically review this Agreement and the Privacy Policy. Your continued use of the website and our Services constitutes your agreement to the Terms of Use and any updates without notice any provided by us. If you object to any changes, you may close your account. Your continued use of our Services would mean that you consent to the updated Agreement. We may change, suspend or end any Service, discontinue the website or change and modify subscription prices prospectively in our discretion. We will provide notice of any material changes. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.

Culture Capital Corp. reserves all its intellectual property rights in the Website and the Services. Using the website or our Services does not give you any ownership in our Services or the content or information made available through our Services. We may use the information and data that you provide and that we have from other Users to connect you with potential employers/candidates. Keeping your profile accurate and up-to-date helps us to make these connections more accurate and relevant.

NO WARRANTY

TO THE EXTENT ALLOWED UNDER LAW, CULTURE CAPITAL CORP, MOVNORTH AND ITS DIRECTORS, OFFICERS, EMPLOYERS, AGENTS, SUBSIDIARIES, AFFILIATES AND OTHER PARTNERS, DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES AND REPRESENTATIONS INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF DATA, AND NONINFRINGEMENT. THE SERVICES (INCLUDING CONTENT AND INFORMATION) ARE PROVIDED ON AN “AS IS” BASIS. WE DO NOT GUARANTEE THAT THE SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS. WE SHALL NOT BE LIABLE TO YOU OR OTHERS FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, REPUTATION, PROFITS OR REVENUES INCLUDING ARISING OUT OF, RELATING TO, OR RESULTING FROM YOUR USE OF THE SERVICES OBTAINED THROUGH MOVNORTH.COM AND INCLUDING BUT NOT LIMITED TO ANY INFORMATION PROVIDED BY YOU, OFFENSIVE OR DEFAMATORY STATEMENTS, DOWN TIME OR LOSS, USE OF, OR CHANGES TO, YOUR INFORMATION OR CONTENT.

LIMITATION OF LIABILITY

IN NO EVENT SHALL THE LIABILITY OF CULTURE CAPITAL CORP, MOVNORTH AND ITS DIRECTORS, OFFICERS, EMPLOYERS, AGENTS, SUBSIDIARIES, AFFILIATES AND OTHER PARTNERS, EXCEED, IN THE AGGREGATE FOR ALL CLAIMS, AN AMOUNT THAT IS THE LESSER OF (A) THE MOST RECENT MONTHLY OR YEARLY FEE THAT YOU PAID FOR A SUBSCRIPTION SERVICE, IF ANY, OR (B) CAD $200.

INDEMNITY

BY ACCEPTING THESE TERMS AND CONDITIONS, YOU AGREE TO INDEMNIFY AND OTHERWISE HOLD HARMLESS MOVNORTH, ITS DIRECTORS, OFFICERS, EMPLOYERS, AGENTS, SUBSIDIARIES, AFFILIATES AND OTHER PARTNERS FROM ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF YOUR ACCESS /USE OF THE SERVICES PROVIDED BY MOVNORTH

These Terms and Conditions shall be governed by the laws of Canada. This Agreement shall be governed by the laws of Canada and in the event of a dispute, you agree to the exclusive jurisdiction of a court of law in the state of Ontario, Canada.

We make the website, movnorth.com (the “Website”) available as a platform for people and organizations to connect as described by our Terms of Service. This privacy policy describes how we collect, store, use and distribute information about our site visitors and our users through the website and services. Consent By using the Website or our Services you consent to the use of your Personal Information as described in this Privacy Policy. Except as set forth in this Privacy Policy, your Personal Information will not be used for any other purpose without your consent. We will not actively collect Personal Information for the purpose of sale or marketing in a way that specifically identifies the individual. In other words, we don’t sell customer lists. We collect information for the following purposes:

  • Registration: To use our services you must provide certain Personal Information to us such as your full name and email address, etc. Only your name may be shared with others on the platform, none of your other account registration information will be shared with any other users of the Website without your permission.

  • Profile: Once you have registered you will be able to create a detailed profile which, this profile will include a profile picture, work experience, skills, a link to your LinkedIn and github profiles, immigration status/work status, website url, etc.

  • Notifications: We will notify you by email or in app notifications of activities related to you such as a new job that matches your skills. In addition to this we may send you notifications of updates such as changes to our Terms of Service or Privacy Policy.

  • Marketing Communications: We may send you marketing communications from time to time, to keep you up to date on our products and services. You opt-out of receiving marketing communications from us at any time by following the opt-out instructions in each communication.

  • Statistics: We also collect usage statistics on the website. Only anonymous aggregate statistics may be shared with third-parties.

  • Recruiters: Your detailed profile will be made available to recruiters registered with the company who’s jobs you apply to. This will include your personal contact information such as email and phone. Your resume and profile is also part of the information made available. Recruiters that find you though search will have to contact you through the platform messaging service to request access to your contact information. You are free to accept or reject a contact from a recruiter your contact information is only shared with recruiters whose communication you have accepted by clicking the accept button.

  • Payment Information: Our platform is currently free for users and only companies recruiting using our platform are charged a subscription fee. All payment information is stored by our Payment Processor Stripe and not by us. We do not process, hold, or store any User credit card or payment information.

  • System Logs and Cookies: Cookies are used by us to track traffic on the Website and to authenticate users on the website. Your IP address is reported by your web browser whenever you visit a page on the Website. This information is recorded together with your registration information on our databases.

If we plan to use your Personal Information in future for any other purposes not identified above, we will only do so after informing you by updating this Privacy Policy. See further the section of this Privacy Policy entitled ‘Amendment of this Policy’.

Disclosures and Transfers

We have put in place contractual and other organizational safeguards with our agents (see further below) to ensure a proper level of protection of your Personal Information (see further Security below). In addition to those measures, we will not disclose or transfer your Personal Information to third parties without your permission, except as specified in this Privacy Policy (see further Important Exceptions below).

We host and store user information on our servers that are located in the United States and accordingly your Personal Information may be available to Canadian and United States government or its agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information.

Our business partners may include: software developers, hardware vendors, system integrators, payment processors, other websites that cater to mailing list management or analytics and our group companies and affiliates. From time to time we may employ third parties to help us improve the Website and/or the Services. These third parties may have limited access to databases of user information solely for the purpose of helping us to improve the Website and/or the Services and they will be subject to contractual restrictions prohibiting them from using the information about our members for any other purpose.

Important Exceptions

We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other members of the Website, other users of the Services, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. The Website and the Services are not intended for use by persons under the age of 18. We do not knowingly collect information about persons under the age of 18. If you think we have collected such information, please contact us and we will remove such information from our systems.

Data Retention

We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained personal information will remain subject to the terms of this Privacy Policy. If you request that your name be removed from our database, it may not be possible to completely delete all your Personal Information due to technological and legal constraints.

Advertising by third parties
